Terms of Service

1. Booking and your deposit

• A date is reserved only when the contract is signed and the deposit is paid. We never hold a date without both.
• A 50% deposit is required to reserve your date. It is non-refundable and is applied to your total.
• The remaining balance is due as shown in your contract and invoice. Payment plans are available.
• We accept payment methods listed on your invoice, such as Venmo, Cash App and Zelle.
• Contracts and invoices are sent by email for your signature.

2. Changing your date or cancelling

Life happens. If you need to change your date, contact us as soon as possible and we will do our best to move you to a new date based on availability. Cancellation and rescheduling terms are set out in your signed contract.

3. Your event day

• Please share your timeline, key moments, family groupings and must have shots before your event.
• We will arrive prepared and on time. Delays or changes to the schedule outside our control may affect coverage time.
• Please make sure we have access, workable lighting and a reasonable place to set up at the venue.
• We are your photographers and filmmakers, not event planners, and cannot be responsible for the schedule or venue rules.

4. Delivery of your photos and films

• Delivery timelines for your photos and films are set out in your contract.
• Online galleries are available for six months after delivery. Please download and back up your files. A gallery backup subscription is available if you want longer access.
• Photos are professionally edited in our signature style. We choose which images to deliver, and we do not provide unedited files unless raw footage was purchased as an add on.

5. Copyright and how you can use your images

Gerald Photo Video keeps the copyright to all photographs and films we create. You receive a personal use license to print, share and post your images and films, including on social media, with credit to Gerald Photo Video appreciated. You may not sell your images, enter them in contests, or license them for commercial use without our written permission. You may not apply filters or edits that alter our signature look and then present the result as our work.

6. Our use of your images

We may use selected images and clips in our portfolio, website, social media, advertising, print and awards, unless you opt out in your contract or in writing. We will never sell your images or use your name or full details without your permission. Clients under 18 are covered by a parent or guardian's permission.

7. Weather, illness and things beyond our control

If a photographer or filmmaker is unable to work your event because of illness, emergency or another reason beyond our control, we will make every reasonable effort to provide a qualified replacement or arrange a solution. Our responsibility in that case is limited to what is described in your contract.

8. Limits of liability

We take great care with your memories and back up our work. In the rare event of loss, damage or failure to deliver because of equipment, data or other issues, our liability is limited to the amount you paid us for the services, as set out in your contract. We are not liable for indirect or consequential damages.

9. Using our website

• The content on this website, including our photos, films, text and logo, belongs to Gerald Photo Video and may not be copied or reused without permission.
• Pricing and availability shown on the site are subject to change until your contract is signed.
• Reviews and testimonials are shared with our clients' permission.

10. Governing law

These terms are governed by the laws of the State of Nebraska.

11. Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last changed. The terms in your signed contract stay in effect for your booking.
